Buying a mortgaged property in Cyprus: questions for the bank and lawyer

Prepare for a Cyprus purchase involving an existing mortgage, with separate checks for registry entries, lender figures and release conditions.

THE ANSWER UP FRONT

Treat the registered mortgage, the current debt and the lender’s release arrangement as separate questions. The lawyer should explain how the proposed payment and transfer will satisfy the actual conditions.

Start with the transaction structure

Tell the lawyer at the beginning that the property is mortgaged or that you have been told it may be. Ask what has been verified and which route is proposed. The required preparation can differ according to the property, title position and existing agreements.

Avoid treating a statement that “the mortgage will be cleared” as a complete plan. Ask who will obtain the lender’s instructions, who will check the figures and how the agreed release will be evidenced.

Ask for the bank’s position

The lawyer needs the relevant lender information to coordinate a release. A property search helps identify registered entries; the bank confirms the applicable financial and release details. Keep an unanswered request to the bank visible as an outstanding task.

Before transferring money, understand the recipient, the purpose, the conditions and the instructions you are relying on. Verify changed bank details through a trusted channel agreed with the professional. A message in a shared workspace should not be the sole basis for redirecting a payment.

Understand the statutory forms

The DLS FAQ on the amended sale-contract law describes mortgage-related procedures involving Forms A and B and a different route involving Form C. These documents should not be treated as interchangeable administrative attachments.

Ask your lawyer which form is being used, what protection the procedure provides and what consequences follow from your signature. If you do not understand the explanation, pause the commitment and ask for it in plain language.

Match the documents to the completion plan

Your preparation notes should name the outstanding condition, the person responsible and the evidence expected. Examples include receiving the relevant bank instruction or obtaining a professional confirmation that a required step has occurred. The exact list belongs to the case, not a universal template.

The transfer procedure also has its own document requirements. Ask the professional to identify what remains before the transaction can proceed at the Land Registry. A satisfactory viewing or a signed draft does not complete that preparation.

Use the platform as the record, not the payment mechanism

Properly’s shared room lets the parties see messages, tasks and lawyer-recorded progress. It does not hold the purchase price, issue a bank release or automatically register ownership. The legal and financial instructions remain with the appointed professionals and institutions.

Avoid uploading confidential bank records to the shared room unless the professional has confirmed the need and the intended recipients. Agree a private channel for sensitive material and keep shared status notes focused on the practical next step.

Ask who confirms each part of the mortgage solution

The registry position, lender conditions, contract protections and final release need different evidence. Identify which professional obtains and interprets each item. A seller’s statement that the mortgage will be paid is not a substitute for the agreed legal and banking arrangements.

Keep time-sensitive documents and payment instructions under review. Verify account changes through the trusted channel agreed with the responsible professional. Properly can organise the requests but does not operate escrow, repay the loan or certify the release.

Your preparation checklist

  • Tell the lawyer about the mortgage before agreeing a completion promise.
  • Obtain current lender instructions and understand the release conditions.
  • Ask what each statutory form means before signing.
  • Verify payment instructions independently and retain completion evidence.

Questions about your next move.

Can a digital platform clear a mortgage?

No. The lender, responsible professionals and relevant official process must deal with repayment and release. Properly organises practical requests and progress.

What should a buyer ask about a mortgaged property?

Ask your lawyer about the registered position, lender requirements, applicable protections and the proposed contract and payment sequence.
